From 5 September 2007, permission will required from recipients of all commercial electronic messages sent.  The Unsolicited Electronic Messages Act is a new legislation brought in to prohibit businesses from sending unsolicited emails and text messages.

What does this mean for you?

  • You will need to review your mail-out lists to ensure that all recipients on the list have provided their permission to receiving commercial electronic messages from you;
  • ensure that you keep this list up to date and track consents;
  • ensure you include unsubscribe option and your contact details;
  • and ensure that your staff are aware of the new rules & comply with them.

More detailed information about changes brought on by the new legislation can be read in this article written by Helen Bowie, Chapman Tripp (March 2007).
